Outdoor Promotion Space – Terms and Conditions

Please fully read the Terms and Conditions before making your application.

  • Promotions should always help to improve the vitality of Chester City Centre and bring benefit to existing businesses and the public, and cause minimal disruption.
  • The promotion must be held within the 5m x 5m space indicated by CH1ChesterBID only.
  • Promotions must not conflict with existing city centre businesses and are subject to approval by the CH1ChesterBID City Centre Manager.
  • The nature of the promotion should not adversely affect pedestrian flows, public safety and the general environment on the interests of surrounding business service or residents.
  • Trading of any kind in not permitted on outdoor promotional spaces.
  • All equipment brought on to the sites must be in a safe condition, satisfy relevant health and safety requirements and must be removed immediately after the event.
  • All promotions should comply with relevant legislation including health and safety, environmental health and highways. The necessary documentation must be available on request.
  • All activity must be covered by Public Liability Insurance with cover of £5m. Some events may require a Risk Assessment and Method Statement. These documents will be requested when appropriate by CH1ChesterBID.
  • If a risk assessment is required for the promotion it is the responsibility of the organiser to produce this 7 days in advance of the promotion.
  • Food is not permitted as part of your promotion without prior approval by CH1ChesterBID.
  • Sampling of alcohol is limited to special terms and conditions. Please contact info@ch1chesterbid.co.uk to receive further information.
  • The areas for both the commercial and charitable sites have been accurately described and measured. Event organisers are required to maintain a presence on the identified site at all times. All on-site representatives must have the provided site details and booking confirmation number with them at all times.
  • The use of the sites does not permit any collections, promotions, sampling or giveaways outside of the allocated 5m x 5m site.
  • On behalf of Cheshire West and Chester Borough Council, CH1ChesterBID reserves the right to refuse permission for any promotion not deemed suitable, and the right to terminate any promotion where the applicant does not conform to the original agreement and conditions.
  • Under no circumstances should your presence create litter of any kind. When handing out samples, waste bins are essential and any waste produced by the promotion must be removed from the site, transported and disposed of in accordance with the environmental protection Act 1990.
  • Organisers are not permitted to hand out stickers which can be misused by the general public.
  • Leafleting is not permitted anywhere in the city centre; all literature must be displayed on a stall for the public to take a leaflet of their own accord.
  • Posters, flyers or any other type of promotional information relating to your promotion cannot be placed on street furniture (including lamp or signposts) or anywhere outside of the promotional space.
  • No part of the promotion/structure should be affixed to the public highway.
  • There is no power or water supply at any of the sites.  You must provide your own low noise generator.  A drip tray must be provided under the generator to avoid oil on the highway.
  • Amplified music or performances that could be interpreted as Busking are not permitted on the sites.
  • The consent holder must ensure that the sound levels generated by the promotion are reasonable and do not cause any noise nuisance to other businesses in the vicinity. If a complaint is received, immediate action must be taken. Loud speakers will not be permitted for the purposes of direct advertising. It is an offence under the Control of Pollution Act 1974 to directly advertise a product or service using a loudspeaker.
  • Flashing lights, lasers or strobe effect lighting are not permitted.
  • If the consent holder (i.e. the applicant/organisation) is asked to move their location by a representative of CH1ChesterBID, Police or Fire Service they must comply with that request. Reasons for this request will be given.
  • The consent holder will be responsible for the reasonable cost of any repair to the highway or street furniture if damage is caused by their event.
  • No vehicles are permitted as part of the promotions.  CH1ChesterBID can apply for a permission for a vehicle if this is required by the promotional activity. If approval is given, drip trays must be shown to a member of CH1ChesterBID before the event can set up; if these cannot be produced the event will be asked to vacate the site. No vehicles are permitted on the York Stone areas of Town Hall Square.
  • Placing a structure upon the Highway will require consent via a license pursuant to section 115e of the Highways Act 1980 (Local Government Miscellaneous Provisions Act 1982).  This condition is included in your approved booking.
  • It is the responsibility of the Charity to comply with the terms of the PRFA should they be signed up to this PRFA Agreement. Cash collections require a Street Collection Licence which can be obtained from Cheshire West and Chester Licensing team at least 28 days in advance; telephone 0300 123 8 123.
  • For pre-approved branded vehicles Cheshire West and Chester Council Parking Services are willing to assist with parking permits (£10 for the first day, £10 for the second day and £20 for any day thereafter) * and information regarding parking for the duration of your stay in Chester for those vehicles specified in the promotion. Please allow a minimum of 48 hours’ notice in advance to ensure your parking needs can be dealt with. Their contact number is 0300 123 7 024.  *correct as at Nov 2015
  • We require payment to terms. Payment must be made on time, in full, and without any deduction, set off or counterclaim. PLEASE NOTE – Sites cannot be booked if there is an outstanding invoice on your account.
  • If your booking is cancelled more than a week an advance you will not be charged. If your event is cancelled with less than a weeks’ notice you will be charged 50% of the rate + VAT.  If your event is cancelled due to adverse weather conditions, CH1ChesterBID will assist with a change of dates.
  • Previous use does not guarantee future permission will be granted.
